Arabic Abstract

تناولت هذه الدراسة الحديث عن الوسيط المالي، سواء كان شخصا طبيعيًا أو معنويا، ومسؤولية هذا الوسيط تُجاه المستثمر.

محدّدًا أن مشكلة الدراسة تكمن في عمل الوسيط داخل سوق الأوراق المالية، ذلك الشخص المرخص قانونا بتداول الأوراق المالية وفق التشريعات المنظمة لذلك.

و بينت هذه الدراسة أن مسؤولية شركة الوساطة المالية في القانون الأردني لا تتعدى في طبيعتها كونها إما مسؤولية عقدية أو تقصيرية، و ذلك استنادا إلى نوع العلاقة التي تربط الوسيط بشخص المتضرّر، فإذا كان قوام هذه العلاقة وجود عقد صحيح بين الطرفين، و حصل إخلال من طرف الوسيط بأي من الالتزامات التي يحددها هذا العقد، و ترتب عليه إلحاق الضرر بالطرف الآخر، فيسأل الوسيط، هنا على أساس المسؤولية العقدية، و بخلاف ذلك، كأن لم يكن هناك عقد بين الوسيط و شخص المتضرر، أو وجد العقد، لكنه كان باطلا، أو موقوفا، و أبطل أو أبرم صحيحا، و حدث ضرر للعميل لسبب آخر غير الإخلال بالالتزامات المترتبة عليه، تكون مسؤوليته مسؤولية تقصيرية.

English Abstract

This study aimed to analyze the impact of entrepreneurial orientation on organizational change management, at Jordanian Commercial Banks; with the presence of knowledge management as a mediating variable.

The study adopted the descriptive - analytical approach, and the study population consisted of (853) elements of all managers in top and middle - level managements at (13) Jordanian Commercial Banks.

The study conducted a comprehensive survey of all study population elements, and used several statistical methods to answer the study questions and test its hypotheses, using the statistical package (SMART-PLS, 3).

The study concluded many results, the most important of them are: the availability level of entrepreneurial orientation, also the adoption level of organizational change management, and the availability level of knowledge management, with their dimensions, have reached a high degree on the five-level Likert scale, at Jordanian Commercial Banks.

The results of study also indicated that there is a statistically significant effect of entrepreneurial orientation, on organizational change management at Jordanian Commercial Banks, and there is a statistically significant effect of entrepreneurial orientation, on knowledge management at Jordanian Commercial Banks, and also indicated that there is a statistically significant effect of knowledge management, on organizational change management at Jordanian Commercial Banks, and indicated that there is an effect of entrepreneurial orientation on organizational change management; in the presence of knowledge management as a mediating variable, at Jordanian Commercial Banks.

The study recommended that more attention should be paid to promote the adoption of entrepreneurial orientation dimensions at Jordanian Commercial Banks; for their important role in organizational change management, and promoting knowledge management.
