Arabic Abstract

تتناول هذه الدراسة أصلاً من الأصول عند علماء الفقه و خصوصاً في المذهب المالكي، و هو أصل مراعاة الخلاف، و هو أصل عظيم لرفع الحرج و الضيق و المشقة عن المكلفين و كان لفقهاء المذهب المالكي مزيد اختصاص به ؛ حيث اعتنوا به في القضاء و الأحكام، و ذكروه في كتبهم و بينوا متعلقاته.

و هذه الدراسة تتناول من جهة التطبيق على هذه القاعدة قضايا الأحوال الشخصية في بناء الأسرة، من خلال عرض مسائل مراعاة الخلاف و مدى مراعاتها في قانون الأحوال الشخصية الأردني.

أبان الباحث فيها عن مراعاة الأسرة و الحفاظ على كيانها في الشريعة الإسلامية، و عن مقصد حفظ النسل و النسب في الشريعة الإسلامية، و عن أهمية الأسرة في الإسلام، كما أبان عن المسائل النظرية المتعلقة بقاعدة مراعاة الخلاف، من جهة معناها، و علاقتها بالأدلة و القواعد الأصولية الأخرى، و عن شروط هذه القاعدة.

و خلص الباحث إلى بعض النتائج كان من أبرزها : ظهور قاعدة مراعاة الخلاف في عدة قضايا في قانون الأحوال الشخصية الأردني، و ذلك في نكاح الشغار، و نكاح المحلل، و النكاح بالمهر غير المقبوض كاملاً، و نكاح المسيار، و النكاح الذي تضمن شرطاً فاسداً، و إيقاع طلاق الثلاث طلقة واحدة.

و بهذا يظهر مرونة قانون الأحوال الشخصية و حفاظه على كيان الأسرة تبعاً لما يقرره علماء المذاهب الفقهية في هذه المسائل

English Abstract

The thesis adresses one of the jurisprudence origins especially on the Maleki school which is consideration the dispute.

It is a great origin to facilitate the difficulties, distress and hardship of those charged in it, and the Maliki jurists had more specialization in it; as they took care of it in jurisdiction and provisions, they also mentioned it in their books and explained what related to it.

This thesis adresses the application of this rule issues on the personal status issues in building a family, by presenting issues of observing the dispute and the extent of consideration it in the Jordanian personal status law.

The researcher stated in the thesis the observance of the family and the preservation of its entity in Islamic law, and on the purpose of keeping offspring and lineage in Islamic law, and on the importance of the family in Islam, as well as on theoretical issues related to the rule of observing the dispute, in terms of its meaning, and its relationship to other fundamentalist evidences and rules, and on the conditions of this rule.

The researcher concluded some of the results, the most prominent of which were: the emergence of a rule of observing the dispute in several cases in the Jordanian personal status law, such as in the exchange marriage, the marriage of the Muhalil ‘the man who married a woman in order to divorce her so that she may go back to her first husband’, the marriage in which the dowry is not fully recieved, the marriage of the Misyar, and the marriage that includes an invalid condition, and the occurrence of the triple divorce as one.

Thus, it shows the flexibility of the Personal Status Law and its preservation of the family entity according to what is decided by scholars of jurisprudence schools in these issues.
