People who frequent (internet) cafes are often subjected to fraud through their e-mails; From time to time, while checking their e-mails, they find messages received stating, for example, that they have won cash reward as a result of conducting a lottery.

In this type of e-mail, the winner is asked to fill in a form that includes a set of data, including his full name, address and bank account number to which the transfer will be made.

The amount of the reward is given to him, and after filling out the form, the answer is returned by requesting a sum of money on the pretext of completing the procedures for disbursing the check, as a result of that, the winner transfers such cash amount and falls into the trap.

There are many other examples of forms of electronic fraud; where it becomes clear to the user that he was a subject to a crime of fraud, which occurred through his e-mail.

In view of the novelty of this type of crime, we have chosen to study this topic in order to clarify the rule of Arab penal laws in it.

The research has been divided into two sections; in the first section, the definition of the crime of e-mail scam has been addressed, and in the second section, demonstrates on clarified the penalty imposed on the perpetrator of e-mail scam.

Finally, the researcher has concluded this research with a conclusions, in which reached a set of conclusions and recommendations asking Ala to succeed in reaching them.
