Arabic Abstract

في هذه الدراسة تلقي الضوء على التلوث البحري من النفط ضمن الاتفاقيات الدولية و نستعرض أهم مصادر التلوث البحري نظراً لخطورته و مدى تأثيره على البيئة البحرية بشكل خاص و البيئة و الانسان بشكل عام و مدى المسؤولية الدولية و معالجتها للتلوث النفطي المستحدث، و توضيح مبادئ المسؤولية الدولية.

و من خلال الدراسة تتحدث عن المسؤولية المترتبة بحق المنتهكين للبيئة البحرية و المسؤولية الجنائية و المدنية في القانون الدولي و تعويض المتضرر عن الضرر الواقع على البيئة، بالاضافة إلى تأثيرها السلبي على المجتمع و الاقتصاد و الحياة و البيئة.

و تستعرض في الدراسة حرب تموز لبنان التي استهدفت خزادات النفط سنة 2006م و بيان لأهم التشريعات اللبنانية للحد من التلوث النفطي و دور الجمعية العامة للأمم المتحدة و أيضاً التشريع الأردني في حماية خليج العقبة المنطقة الاقتصادية و دور الجمعية الملكية لحماية البيئة البحرية و مدى تطبيق القوانين الوطنية للحد من التلوث النفطي و التنسيق في ما بينها و إزالة الغموض.

حيث تم التوصل إلى أهم النتائج أن معظم الدول تقوم بالاخذ بالتدابير الاحترازية بعد وقوع حادثة التلوث و ليس قبلها، و يعتبر الأردن من أوائل الدول التي عملت على المصادقة على الاتفاقيات الدولية العاملة للتقليل من حوادث التلوث و ايجاد الحل الفعلي لها .

و توصلت الدراسة إلى توصيات كان أهمها : العمل بأخذ مبلغ مالي احتياطي من البواخر الناقلة للنفط و التي قد تتسبب بالتلوث و في حال حدوثه يعود المبلغ للدولة للتعويض عن الخسائر.

و أن يتم المل على انشاء محكمة خاصة للشؤون البيئية و توجد جهة للاختصاص القضائي للاستجابة الفورية بالنظر فيها و تمكين المواطنين من حق اقامة الدعوى المسوؤلية باعتبارها حق مشترك للمجتمع الانساني.

English Abstract

In this study we will shed light on the marine pollution caused by oil within international conventions.

We will review the sources of marine pollution due to its seriousness and the extent of its impact on the marine environment in particular and on the environment and people in general and the extent of international responsibility in treatment of the new oil pollution and clarifying the principles of the international responsibility.

We will talk through the study about the liability arising from violators of the marine environment, and the criminal and civil liability in international law and the compensation for the injured for damages caused to the environment, in addition to its negative impact on society, economy, life and the environment.

In the study, we review the July War in Lebanon, which targeted the oil reservoirs in 2006, and show the most important Lebanese legislation to reduce oil pollution, the role of the United Nations General Assembly, as well as the Jordanian legislation in protecting the Gulf of Aqaba, the economic zone, the role of the Royal Society for the protection of the marine environment and the extent of application of national laws to reduce oil pollution and the coordination In between and to wave ambiguity.

The most important results were reached, which is that most countries take precautionary measures after the occurrence of the pollution incident and not before.

Jordan is one of the first countries that worked to ratify international conventions aiming to reduce pollution incidents and find an actual solution to such problem.

The study found recommendations, the most important of which were: Taking a reserve amount from ships carrying oil and which may cause pollution, and pay such amount to the state as a compensation for losses in the event of such pollution, working on establishing a special court for environmental affairs, finding a body of judicial competence to immediately respond in the case and to enable citizens to file a case of responsibility as it is a common right of the human community.
