Abstract EN

The commentators of private international law are unanimous in depriving the foreigner of the enjoyment and exercise of the right to stand for election and to be elected, because of the extreme importance of establishing the state, politically, economically and socially.

but this unanimous view does not hold; a new global constitutional trend has went towards granting the foreigner this right.

Multiple Arab legislation has divided this right between the original and the national emergency - naturalized - by giving the right to the first and prohibiting it from the second, while there is an Arab legislative trend that goes towards granting an olute settlement between the patriots, both genuine and emergency, in the exercise of this right.

Based on this, the research was to explore the depths of this subject and reveal its truth, through its constitutional and legal rooting, which leads to correcting the unanimous view between the commentators and researchers on the one hand, and to open the doors to other researchers and draw their attention to the fact that the issue in question has taken place in a new direction at the constitutional and legal levels on the other hand.
