Abstract EN

This research is a study that shows the importance of jurisprudence of reality, in view of its great importance in the lives of many Muslims, especially the religious rulings, as the reality of Muslims is taken into account in all aspects of their lives, and thus the rulings are descended according to that observance of facilitating, mitigating, expanding and permitting, and according to what they require each case is separate, and jurisprudence of reality has existed since the beginning of Islamic legislation and to this day, as the Islamic legitimacy took into account the jurisprudence of reality, but it is one of its basics, as there is ease for people in it, and the evidence of that is the facilitation of people in the issue of the prohibition of alcohol, as it has gradually been in line with the jurisprudence of reality, and the Islamic Sharia is the Sharia that is suitable for every time and place in terms of dissolution, prohibition, facilitation and difficulty, and what we are dealing with is the ruling on mobile divorce.

The Islamic Sharia has taken into account in its folds what is derived from jurisprudential issues and mobile divorce from the cases used in this era.

And that the Holy Qur'an and the pure Sunnah took into account the reality that Muslims live in, and the Iraqi law took into account the jurisprudence of reality and approved provisions that are in line with the reality of people, and I mentioned mobile divorce as a model.
