Arabic Abstract

هدفت هذه الدراسة إلى التعرف على الإطار القانوني لخدمات الأمن السيبراني (دراسة مقارنة) و معرفة مفهوم الفضاء السيبراني وتأثيرها على دول العالم، حيث اعتمدت الدراسة على المنهج الوصفي و تم الاستعانة لغايات الاستدلال، ويعتبر الأمن السيبراني هو مجال متغير باستمرار، مع تطوير التقنيات التي تفتح آفاقاً جديدة للهجمات الإلكترونية، و على الرغم من أن الانتهاكات الأمنية الكبيرة هي التي يتم الإعلان عنها فقط، إلا أنه لا يزال يتعين على المؤسسات الصغيرة أن تهتم بالانتهاكات الأمنية، حيث قد تكون غالباً هدفاً للفيروسات و التصيد الاحتيالي.

وقد خلصت الدراسة إلى مجموعة من النتائج كان من أبرزها : 1- ان الأمن السيبراني يقوم على حماية المنظمات و الموظفين والأفراد، يجب على المنظمات و الخدمات تنفيذ أدوات الأمن السيبراني وا لتدريب و أساليب إدارة المخاطر و تحديث الأنظمة باستمرار مع تغير التقنيات و تطورها.

2- تبين من الدراسة ان المشرع الأردني لم يعالج في قانون الأمن السيبراني الأردني المسائل التقنية و الفنية لحادث الأمن السيبراني من حيث الطبيعة و الاثر و التصنيف، الأمر الذي من شأنه التأثير على ضمان الحماية المقررة أو المرجوة للأمن السيبراني و سلامة الفضاء السيبراني الأردني.

كما أوصت الدراسة بضرورة مبادرة المشرع الأردني لإيجاد قواعد قانونية خاصة ناظمة لالتزامات و حالات قيام مسؤولية مقدمي خدمات الأمن السيبراني : الجزائية، و المدنية، و حالات الإعفاء منها.

و هو ما سيترك آثاراً إيجابيةً ستؤدي إلى زيادة حجم التبادل المعلوماتي الإلكتروني، و متشجع الإقدام على الاستثمار في هذا القطاع الشرياني، فتعم المنفعة على اقتصادنا الوطني، و أوصت أيضًا ضرورة أن تسمح التشريعات، في هذا المجال، باللجوء لدعاوى أو لطلبات وقف بث المضمون الإلكتروني غير المشروع، و أن يتم بدقة، تحديد الإجراءات الواجب إتباعها لسحبه، أو لمنع وصوله لمستخدمي الشبكة..

English Abstract

This study aimed to identify the legal framework for cybersecurity services (a comparative study) and to know the concept of cyberspace and its impact on the countries of the world, where the study relied on the descriptive approach and was used for the purposes of inference, and cybersecurity is a constantly changing field, with the development of techniques that open new horizons For cyber-attacks, although only major security breaches are reported, small organizations still have to take care of security breaches, as they can often be the target of viruses and phishing.

The study concluded a set of results, the most prominent of which are: 1- Cyber security is based on the protection of organizations, employees and individuals.

Organizations and services must implement cyber security tools, training, risk management methods, and constantly update systems as technologies change and evolve.

2- The study showed that the Jordanian legislator did not deal in the Jordanian cyber security law the technical and technical issues of the cyber security incident in terms of nature, impact and classification.

This would affect the guarantee of the planned or desired protection for cyber security and the safety of the Jordanian cyber space.

The study also recommended the necessity of the Jordanian legislator’s initiative to find special legal rules regulating the obligations and cases of liability of cybersecurity service providers: criminal and civil, and cases of exemption from them.

This will leave positive effects that will lead to an increase in the volume of electronic information exchange, and will encourage investment in this arterial sector, thus benefiting our national economy.

It also recommended that legislation, in this field, allow recourse to lawsuits or requests to stop the transmission of illegal electronic content, and that the procedures to be followed to withdraw it or to prevent its access to network users should be precisely defined.
