Research topic : research deals with the rule of amnesty for capital punishment by, and the impact in the fall of punishment punitive.

research objectives : this research aims to clarify the position of Islamic law on pardoning the punishment of the punishment of the punishment, and clarifying the effect of pardon on the failure of discretionary discretion.

research methodology : the inductive analytical approach, and the comparative approach.

research results : the most important results include a number of results, including: that the punishments of condolence are types, which are not limited or arrested, but rather the judge to adopt appropriate means of strengthening from old or new, which does not violate the law and achieves the purposes of punishment, including : that the guardian’s pardon for crimes of chastity that is rightly due to Allah does not in any way affect the rights of the victim.

research recommendations : the research included a number of recommendations, including: the legalization of condolence sanctions, and the establishment of general controls that ensure that they are applied in the required way, and achieve the desired purposes and interests.
