Arabic Abstract

تؤدي كافة البرلمانات في الأنظمة النيابية وظيفة الرقابة البرلمانية على السلطة التنفيذية، و لعل الهدف من ذلك هو إقرار الرقابة و تأكيدها في الدستور و هذا يعتمد على أن السلطة التشريعية تمثل الشعب و تتحدث باسمه و لذلك فإن رقابتها السياسية تعتبر من أهم الاختصاصات التي يمارسها هذا المجلس و التي يجب أن تكون رقابة فعلية و محققة لأهدافها وغاياتها.

مظاهر الرقابة البرلمانية على السلطة التنفيذية في كل من الأردن و مصر محددة بمجموعة من الوسائل و الإجراءات، فإن هذه الدراسة البحثية هدفت لتداول هذه الوسائل التي تتمثل في السؤال - الاستجواب - المسؤولية السياسية – و طرح الثقة - والتحقيق البرلماني – و طرح موضوع عام للمناقشة – و إبداء الرغبات و تقديم العرائض (و الشكاوى و تبين من هذه الدراسة أن هناك عوامل أنت لضعف فعالية هذه المجالس البرلمانية للقيام بدورها على أكمل وجه.

و إقرار المسؤولية السياسية للحكومة سواء كانت هذه المسؤولية فردية أو تضامنية، كون الوزراء في السلطة التنفيذية هم يمثلون المرجع الأساسي الذي تعود له صلاحية رسم السياسة العامة للدولة و القيام بالأعمال التشريعية، إضافة لصلاحيات الوزير الإدارية و غيرها من الصلاحيات، فعند إحالة المسؤولية عن السياسة العامة للدولة للوزراء في النظام البرلماني هذا له حكمة في ربط المسؤولية بالسلطة بمعنى أنه حيث توجد السلطة توجد المسؤولية.

و تخلص الدراسة أيضاً إلى أن الوقت والتجربة و الديمقراطية هي أسس أساسية لبناء دولة تحترم القانون و الحرية، و مبادئ الديمقراطية، بإحترمها حقوق المواطنين في العيش في دولتهم التي تحترم حقوق مواطنيها و كرامتهم.

English Abstract

All parliaments in representative systems perform the function of parliamentary oversight over the executive authority, and perhaps the goal is to approve and confirm oversight in the constitution, and this depends on the legislative authority representing the people and speaking in its name.

Actual and achieved its goals and objectives.

The manifestations of parliamentary oversight of the executive authority in both Jordan and Egypt are defined by a set of means and procedures.

This research study aimed to address these means, which are represented in (question - interrogation - political responsibility - putting up trust - and parliamentary investigation - putting forward a general topic for discussion - expressing desires and submitting petitions.

And complaints) It is clear from this study that there are factors that led to the weak effectiveness of these parliamentary councils to carry out their role to the fullest.

And the approval of the political responsibility of the government, whether this responsibility is individual or collective, since the ministers in the executive branch are the main reference that has the authority to draw the state’s general policy and carry out legislative work, in addition to the minister's administrative powers and other powers, when assigning responsibility for the state’s public policy to ministers in This parliamentary system has the wisdom to link responsibility with authority in the sense that where there is authority there is responsibility.

The study also concludes that time, experience and democracy are basic foundations for building a state that respects the law, freedom, and principles of democracy, by respecting the rights of citizens to live in their country that respects the rights and dignity of its citizens.
