Abstract EN

This paper argues that a member of parliament should held accountable for voluntarily changing political party affiliation as described on the ballot paper when he was elected.

Changing political affiliation literary means that voters’ decision as expressed at a democratic election is overturned, the issue that could have direct impact on democratic governance.

Hence the contemprary political systems have changed, and voters are no longer vote for candidates personally, but indeed they vote for parties.

In addition, party jumping could have significant consequences and could change the political dynamics of the parliament the issue that was not possible before the defection.

The paper is divided into three sections.

While the first discusses the basis of the responsibility, the second devoted to look at the Actions trigger this responsibility and the entity investigating the relevant representative in this case.

The third section examines the measures can be taken in such cases and the extent to which a member of parliament can be disqualified under the Iraqi law comparing to the Egyptian law
