Arabic Abstract

لا شك في أن الضمان الصحي يعد من الحقوق الدستورية التي كفلتها دساتير دول العالم، ومنها دستور جمهورية العراق؛ لأهمية هذا الحق وآثره على تقديم الخدمات الصحية والطبية لأفراد المجتمع، كما وأن توسع دور الإدارة، وزيادة تدخل الدولة في المجالات كافة صدر قانون الضمان الصحي رقم (22) لسنة 2020 موضحا كيفية الشمول بالضمان الصحي والآلية المتبعة؛ لتحقيق الأهداف التي شرع من أجلها القانون أعلاه، وتحقيق ما تقدم لا يمكن دون أن يكون دون وجود العناصر البشرية لإشغال الوظائف التي رسمها قانون الضمان الصحي، فهم يشكلون أداة الهيأة في ممارسة الوظائف المناطة بها تحقيقا للصالح العام من خلال تقديم الخدمات التي يحتاجها المواطن، ولذلك فقد أشار المشرع العراقي إلى الألية القانونية لإشغال الوظائف في الهيأة.

English Abstract

There is no doubt that health insurance is one of the constitutional rights guaranteed by the constitutions of countries around the world, including the constitution of the republic of Iraq.

because of the importance of this right and its impact on the provision of health and medical services to members of society, as well as the expansion of the role of the administration, and the increase in the state's intervention in all areas, the health insurance law no.

(22) of 2020 was issued, explaining how to include health insurance and the mechanism followed; to achieve the goals for which the law was enacted above, and to achieve the foregoing cannot be without the presence of human elements to occupy the jobs drawn up by the health insurance law.

therefore, the Iraqi legislator referred to the legal mechanism for filling positions in the commission.
