Abstract EN

This study sought to shed light on the transfer of the responsibility of the current head of state for international crimes to the national judiciary, where Gabriel Almond used the approach of functional constructivism.

It dealt with the nature of the relationship between national judiciary and international law towards criminal responsibility.

This study concluded several points, the most important of which is that the international judiciary did not abolish the role of the national judiciary in bringing cases against natural persons, regardless of their official status, and it includes heads of state.

The national law in prosecuting persons who have committed crimes, or in cases of serious international crimes, and in accordance with the provisions of the Rome Statute of 1998 AD.

While the researcher found that the power of the international judiciary and its procedures in achieving justice and holding the perpetrators of international crimes accountable, especially on the signatory countries of the international conventions concerned with the accountability of the perpetrators of international crimes, but even the non-signature in the event of the Security Council assigning the International Criminal Court and within cases of threats to international peace and security.
