يعتبر الحق في السلامة الجسدية من أقدس الحقوق التي تمتع بها الإنسان، إذ هي لصيقة بشخصه، هذا الحق الذي اتفقت جل التشريعات السماوية و الوضعية على العناية به و حمايته عبر جميع مراحل تكوينه، و إن اختلفت وسائل الحماية و الضوابط الموضوعة لها.
و قد تجلت صور الحماية القانونية في الجانب الطبي أثناء العلاج، و الجانب الجنائي أثناء تجريم كل أشكال الاعتداء على السلامة الجسدية، أثناء الحياة و حتى بعد الوفاة باعتبار الجثة تتمتع بحرمة وجبت صيانتها من العبث و الاستغلال، و من هنا تظهر الفوارق بين الشريعة و القانون في تجسيد هذه الحماية التي يعود نفعها على المجتمع.
و لذلك تناول البحث مفهوم الخطأ الطبي من حيث الطبيعة القانونية للمسئولية و هل الطبيعة القانونية للمسئولية الطبية (مسئولية تعاقدية أم مسئولية تقصيرية) صور الحماية القانونية.
English Abstract
The medical responsibility of the doctor the right to bodily integrity is considered one of the most sacred rights enjoyed by man, as it is closely related to his person, this right that most of the heavenly and man-made legislations agreed to take care of and protect it through all its stages of formation, even if the means of protection and the controls set for it differ.
the forms of legal protection were manifested in the medical aspect during the treatment, and the criminal aspect during the criminalization of all forms of assault on bodily integrity, during life and even after death, considering the corpse enjoys a sanctity that must be preserved from tampering and exploitation, and from here the differences between Sharia and law appear in the embodiment of this protection that benefits society.
this is Egypt's vision 2030 in the health field.
therefore, the research dealt with the concept of medical error in terms of the legal nature of liability and whether the legal nature of medical liability (contractual or tortuous liability) pictures of legal protection.
