Arabic Abstract

يعد تفعيل السجلات الطبية الإلكترونية، استجابة للتحول الرقمي في كافة القطاعات، و من ضمنها قطاع الرعاية الصحية، على أثر استمرار انتشار (Coronavirus) COVID-l9، و ما ترتب عليها من توقف لأغلب الأنشطة و الأعمال، الأمر الذي ترتب عليه ضرورة التعايش مع هذا الوباء، و تكمن أهمية الدراسة في حق الإنسان في تحسين كفاءة الرعاية الصحية المقدمة له من خلال مجتمع معلوماتي قائم المعرفة و التنمية الاجتماعية و الاقتصادية.

و نظرا لحساسية البيانات التي تفصح عن الحالة الصحية للإنسان لابد من التصدي لإشكالية ؛ حماية أمن و خصوصية و سرية البيانات التي يحتويها السجل، من أي تلاعب أو اختراقها، و من أجل معالجة هذه الإشكالية يستوجب الأمر طرح ثلاث تساؤلات ؛ الأول ؛ ما مدى توافق التشريعات الحالية في تحقق سبل حماية السجلات الطبية الإلكترونية ؟ الثاني : هل يمكن للتقنيات الرقمية، توفير معايير الأمن و الحماية للسجل الطبي الإلكتروني ؟.

الثالث ؛ هل يحتاج السجل الطبي الإلكتروني تنظيم قانوني شامل، لمواجهة الأخطاء الطبية الناشئة من الممارسات غير المشروعة.

لذلك تم الاستعانة بالمنهج التحليلي لدراسة النصوص التشريعية المتعلقة بخصوصية البيانات الشخصية، و نقل و زراعة الأعضاء و البحوث الإكلينيكية و التشريعات ذات العلاقة ؛ حيث إنه المنهج الأكثر ملاءمة لطبيعة الموضوع لإبراز ظاهر التميز و القصور في التشريعات القائمة، و استخلاص المعايير المتوافقة مع طبيعة السجل الطبي الإلكتروني.

و قد ارتكزت الدراسة عل عنصرين، الأول، الأساس القانوني للسجلات الطبية الإلكترونية في النظم القانونية الوطنية و الدولية.

و الثاني ؛ ضوابط حماية السجلات الطبية الإلكترونية في ضوء التطور التشريعي و التقني، و إلقاء الضوء على التجارب المتميزة في بعض الدول.

و خلصت الدراسة إلى ضرورة إصدار تشريع الرعاية الصحية تحت مسمى "القانون الطبي" يشمل معايير حماية السجلات الطبية الإلكترونية على أن يتم الرجوع إلى الأدلة الاسترشادية لمنظمة الصحة العالمية في تفعيل السجلات الطبية الإلكترونية بالتوافق مع تقنية بلوك تشين المتخصصة في أمن و حماية معاملات القطاع الصحي.

English Abstract

The application of electronic medical records conforms with the neo-digital era that has undergone dramatic changes in all sectors, including health care.

this issue is further urged by the COVID-19 pandemic and the suspension of most activities and businesses.

all these factors necessitate co-existing with the pandemic.

the objectives of the work is to improve the efficiency of health care provided through an information-based society that prioritizes knowledge and socio-economic development.

the research problem is how to deal with the privacy and security of data related to patients, given the sensitivity of such sort of data.

thus, it is a problem to attempt to protect such data from manipulation or any misuse.

the research questions are : what is the compatibility of current legislation in achieving ways to protect electronic medical records ? ; can digital technologies provide security and protection standards for the electronic medical record ; and does the electronic medical record need a comprehensive legal regulation, to confront medical errors arising from illegal practices ? moreover, the research adopts an analytical methodology to study the legislative texts related to the privacy of personal data, organ transfer and transplantation, clinical research and related legislation ; as it is the most appropriate approach to the nature of the subject to highlight the manifestations of distinction and shortcomings in the existing legislation, and to derive appropriate criteria for the nature of the electronic medical record.

the analysis is of two sections : first, the legal basis for electronic medical records in the national and international legal systems ; second, criteria for the protection of electronic medical records in the light of legislative and technical development, and demonstration of related counterpart encounters in other countries.

the study concluded that it is necessary to issue health care legislation under the name of "medical law" that includes standards for the protection of electronic medical records, provided that reference is made to the guidelines of the world health organization in activating electronic medical records in accordance with the use of Blockchain technology specialized in the security and protection of health sector transactions.
