Arabic Abstract
تناولت الدراسة ضمانات المتهم في مرحلة التحقيق الابتدائي دراسة مقارنة.
القانون الأردني و القانون العماني و تأصيله و تحليله و مدى توافقه مع الاتفاقيات و الضمانات الدولية المتعلقة بحقوق الإنسان.
و أبرز ما توصلت إليه الدراسة أن افتراض براءة المتهم حتى تثبت إدانته بحكم نهائي و نهائي يشكل ضمانة مهمة للمتهم، ليس فقط خلال مرحلة التحقيق النهائي (المحاكمة)، بل خلال مراحل التحقيق المختلفة.
و من لحظة القبض على المتهم، و أن قرينة البراءة تهدف إلى حماية شخص المتهم وعدم الإضرار به، و الحفاظ على حقوقه و حريته، كما تهدف إلى تجنب الأضرار التي قد يتعرض لها المتهم.
يعاني إذا حوكم على أساس أنه أدين وثبت براءته فيما بعد.
English Abstract
The study dealt with the guarantees of the accused in the stage of the preliminary investigation, a comparative study.
Jordanian law and Omani law, its rooting, analysis, and its compatibility with international conventions and guarantees related to human rights.
The most prominent finding of the study is that the assumption of the accused’s innocence until proven guilty by a final and final judgment constitutes an important guarantee of the accused, not only during the final investigation stage (trial), but during the various stages of investigation and from the moment the accused was arrested, and that the presumption of innocence aims to To protect the person of the accused and not to harm him, and to preserve his rights and freedom, and it also aims to avoid the damages that the accused might suffer if he were tried on the basis that he was convicted and then proved his innocence later.
The study recommended that ensuring the suspect’s right to the assistance of a lawyer is necessary at the stage of inference to protect the rights of individuals from the abuse of the authority.
