Arabic Abstract

هدفت الدراسة بيان مسؤولية الصيدلي المدنية عن عمليات صرف الدواء وفق قانون المسؤولية الطبية و الصحية الأردني، و لأجل تحقيق أهداف الدراسة تم استخدام المنهج التحليلي القائم على تحليل النصوص ذات العلاقة وكذلك المنهج المقارن عند الحاجة، و قد توصلت الدراسة إلى النتائج التالية : تتعدد أشكال المسؤولية في حالة الشخص الذي يرتكب فعلاً يستوجب المؤاخذة، فإذا كان الفعل مخالفا لقواعد الأخلاق، وصفت مسؤوليته بأنها مسؤولية أدبية، فتقتصر هذه المسؤولية على استنكار المجتمع لفعله و تتحقق مسؤولية الشخص عن أفعاله الضارة و فقا لأحكام القانون المدني الأردني متى ثبت أن الضرر ناجم عن الفعل الصادر عن المسؤول بحيث يستحق المقصر العقوبة عن الفعل الذي ارتكبه، و قد أوصت الدراسة بأنه على المشرع الأردني عند إعادة النظر في صياغة قانون الصيدلة و الدواء الأردني من خلال التعرض لحكم الصيدلي الذي يسلم المريض دواء غير صالح للاستعمال بأن ذلك لا يشكل عيبا خفيا يضمنه الصيدلي وفقا لأحكام القانون المدني الأردني و إنما يلزم بالضمان وفقا لمخالفته أحكام قانون الصيدلة والدواء الأردني، و قد أوصت الدراسة بضرورة إجراء مزيد من الدراسات حول المسؤولية المدنية للصيدلي.

English Abstract

The study aimed to reveal the civil liability of the pharmacist for his professional error in accordance with the Jordanian Medical and Health Liability Law.

The analytical approach was used based on analyzing the relevant texts as well as the comparative approach.

The study reached the following results: There are many forms of responsibility in the case of a person who commits an act that requires accountability.

If the act violates the rules of morality, his responsibility is described as a moral responsibility, then this responsibility is limited to society’s denunciation of his act, and the person’s responsibility for his harmful actions is achieved in accordance with the provisions of the Jordanian Civil Code when it is proven that the harm is caused by the act issued by the official.

The study recommended that the Jordanian legislator when Reconsideration of the drafting of the Jordanian Pharmacy and Drug Law Exposure to the judgment of the pharmacist who delivers the patient an unusable drug that this does not constitute a hidden defect guaranteed by the pharmacist in accordance with the provisions of the Jordanian Civil Code, but is required to guarantee in accordance with the violation of the provisions of the Jordanian Pharmacy and Drug Law, and that the warranty period is (15) years
