Abstract EN

The right to union work acquires its importance as it constitutes an objective criterion for measuring the extent to which democracy is practiced, and the extent of adherence to its principles.

this is due to the organic link between the union right and the general and fundamental freedoms of man.

the creation of all forms of unions is made in accordance with a constitutional and legal regulations in an independent and constant fashion.

the Palestinian lawmaker has followed the norms pursued by other legislators as the amended Palestinian basic law of 2003 guaranteed the organization of unions work and the formation of syndicates.

constitutions guarantee the principle of freedom of union work for all individuals, whether in establishing a union or joining it as a right for individuals.

law regulates the provisions of this right, which is the basis for organizing union work.

the right to establishing syndicates and the right to joining them must be intertwined i.e., the right to establish the unions and the right to join them.

the Palestinian lawmaker sufficed with referencing this right under article (25 / paragraph 3) of the basic law which states “unions organization is an established right regulated by law”, and under article 26 / paragraph 2 “the formation of unions, associations, syndicates, federations, leagues, clubs and popular institutions shall be regulated in accordance with the law.” through this study, the two researchers tried to research the level of financial independence for union work, while it is necessary to research the administrative independence of union work.
