The growing worldwide interest in the risks that threaten all mankind and the environment is due to the significant generation of hazardous wastes around the world.

the operations of transporting waste across the borders from developed countries to developing countries and their recycling pose a threat to the environment, especially since most developing countries do not have the technical capacity and facilities necessary for the disposal of this waste in an environmentally sound manner.

this prompted members of the international community to ban the transfer of hazardous wastes across borders and to prevent illegal traffic in order to protect the interests of the international community.

in the event of a breach of this undertaking, the state concerned bears full responsibility for damage resulting from the transfer of waste and illegal traffic, in accordance with the provisions of international law.
