تهدف هذه الورقة البحثية إلى دراسة وتحليل إحدى صور التمويل الإسلامي في البنوك والمؤسسات المالية الممارسة للصيرفة الإسلامية، والمتمثلة في صيغة الإجارة بصورها المختلفة، حيث حظيت بانتشار واسع في مجال التعاملات الاقتصادية المعاصرة، من خلال دعمها لتطوير قاعدة الأصول الإنتاجية للمستأجر مما يؤدي إلى زيادة قدرة المنشآت الاقتصادية المحلية على المنافسة ومواكبة التطور.
وتوصلنا إلى أن الإجارة أداة من أدوات التمويل الإسلامي، تساهم مع باقي الصيغ في تحقيق التنمية الاجتماعية والاقتصادية، ولقد أدرجها المشرع الجزائري في النظام 02-20 والتعليمة 2020-03، وافرد لها أحكاما خاصة بها، إيمانا منه بأنها من اهم مصادر التمويل، وذلك دون الحاجة إلى الضمانات التي تحتاجها مصادر التمويل الأخرى، وأنها تتماشى مع قلة الموارد المالية للأفراد الراغبين في التملك، وغير القادرين على الشراء مباشرة، كما أنها تساعد في ترغيب العملاء في الحصول على أنواع متعددة من الأصول، أو عتاد المصانع والتجهيزات، دون الحاجة إلى إنفاق مبالغ كبيرة لشراء الأصول الجديدة.
Abstract EN
This paper aims to study and analyze one of the forms of Islamic finance in banks and financial institutions practising Islamic banking, namely the Ijara formula in its various forms, where it has enjoyed a wide dissemination in the field of contemporary economic transactions, through its support for the development of the tenant's productive asset base, thereby increasing the competitiveness of domestic economic enterprises.
we have concluded that Ijarah is an Islamic financing instrument that contributes to social and economic development with the rest of the formulae.
Algerian legislation has incorporated it into regulation 20-02 and education 03-2020, and has its own provisions, believing that it is one of the most important sources of financing, without the need for the guarantees required by other sources of financing.
