الفساد بلاء عالمي، انعكست عواقبه على كافة القطاعات، و لأنه يشكل خطرا مهددا للتنمية، مما دفع إلى تحرك الجميع لمكافحته على الصعيدين الدولي و الوطني بالتركيز على مكافحته بدءا بآليات الوقاية من وقوعه و انتهاء بالردع للحد من توسع انتشاره، و المشرع في هذا السياق مسايرة للمواثيق الدولية و في مقدمتها معاهدة الأمم المتحدة للوقاية و مكافحة الفساد و من خلال التعديل الدستوري لسنة 2020 المنشئ لمؤسسة السلطة العليا للشفافية و الوقاية من الفساد جسد هذه المؤسسة بقانون 22-08 لتعزيز القانون 06-01 المتعلق بالوقاية من الفساد و مكافحته.
Abstract EN
The corruption is a worldwide scourge, whose repercussions extent to all sectors, and who is a threat to development, therefore, important measures have been introduced against corruption at both international and national levels ; starting with implementation of preventive mechanisms continuing with imposition of dissuasive and punitive measures halting its spread, this is why the legislator, in accordance with international instruments, including the united nation convention against corruption, and through the constitutional amendment of 2020 establishing the institution of the high authority of transparency and combating corruption, implemented this institution under the law 22-08 to enhance the law 06-01 relating to prevention and fight against corruption.
