Abstract EN

A new type of commercial companies in the commercial law has been included, according to law n° 22-09 of May 5, 2022.

it is called the "simple Joint-Stock company".

in accordance with the provisions of the law mentioned before, this type of commercial company is exclusively for start-ups.

this research aims to study the legal system for establishing a simple joint stock company, by clarifying the legislator’s intention to include this new type within the commercial companies, by highlighting the features and characteristics of this company, and the conditions for its establishment, through a comparative study with French legislation, given that the provisions of Algerian law are derived from it.

through this study, several results were reached ; the most important of which is the identification of the location of the simple joint stock company within the system of commercial companies, what distinguishes it from other companies, and also knowing the category concerned with this new form of commercial company, as well as the legally required conditions for its establishment.
