Arabic Abstract

يتضمن هذا البحث ) أثر اعتبار المآل في فتوى النوازل ( في مبحثه الاول الى بيان و تعريف لاعتبار المآل فياللغة و الاصطلاح، و يتضمن أدلة هذا الاعتبار في تأصيل فتوى النوازل، و هذه الأدلة ورد ذكرها في الكتابوالسنة و فعل الصحابة، وهي كثيرة ولاسيما في السنة و فعل الصحابة رضي الله عنهم، وقد اخترت منها ما كانقريب الشبه مما يحصل من مستجدات في واقعنا المعاصر، كما بينت في هذا المبحث مدى التلاقح فيما بين مقاصدالشريعة و اعتبار المال و ضرورة حضور هذين المعيارين في ذهن الفقيه و المفتي الذي يتعرض للنظر و التأصيل فيالنوازل و المستجدات المعاصرة.

اما المبحث الثاني فجاء في ضوابط الفتوى، وأول ما تم تناوله في هذا المبحث تعريف الفتوى لغة و اصطلاحا، أما المطلب الثاني فجاء في شروط المفتي و بيان المؤهلات التي يجب توفرها في المفتي، وأما المطلب الثالث فجاء فيمجموعة المعايير التي يلحظها المفتي في تكييف النازلة و تأصيل حكمها، وأما المطلب الرابع فجاء في كون اعتبارالمال ركن في فتوى النوازل.

وأما المبحث الثالث: فتضمن نماذج تطبيقية لبعض النوازل، منها: عدم إقامة الجمع و الجماعات و الأعياد فيالمساجد، و منها: حكم التباعد بين المصلين في صلاة الجماعة أيام الوباء.

English Abstract

The impact of considering destiny in the advisory opinion of recent occurrencesThe first section of this paper involves the definition and proclamation of the considerationof destiny in idiomatic and linguistic.

In addition، it includes the evidences of thisconsideration in the advisory opinion voucher of the recent occurrences and events.

Thus، those evidences had been presented (mentioned) in Al-Sunna، Qur'an، and companions'action.

They are too much especially in Al-Sunna and companions' action (May Allah bepleased with them).

Moreover، the researcher has selected، out of those evidences، the oneswhich have a close similarity to what happens in our contemporary reality.

Furthermore، this section also showed the extent of compatibility between the conditions of law andthe consideration of destiny.

Besides، there is a necessity for the given two standards tobe present in jurist and mufti's mind who is subjected to the introspection of the recentoccurrences and contemporary evolvements.

As far as the second section is concerned، this section devotes the conditions of advisoryopinion.

Thus، the first thing indicated in this section is the idiomatic and linguistic definitionof the advisory opinion (Al-Fatwa).

As for the second requirement، it showed the conditionsof Al-Mufti and the recommended qualifications that he should have.

Furthermore، thethird requirement showed a collection of standards which are diagnosed by Al-Mufti inunderstanding of the recent occurrences or events and determining its scope.

What ismore، the fourth requirement showed that the consideration of destiny is a base in advisoryopinion (Al-Fatwa) of the recent occurrences and events.

As far as the third section is concerned، this section includes applicational models forsome recent occurrences and events such as; the prevention of holding gatherings andfeasts in mosques and ruling on distancing among worshipers in congregationalprayer during epidemic days.
