تقييم واقع تعددية عضوية الرقابة الشرعية : دراسة تحليلية على المؤسسات المالية الإسلامية في ضوء تعليمات الحاكمية للبنك المركزي

Abstract EN

This study aims at investigating the multiplicity of the membership in Sharia Supervisory Board for the Islamic financial institutions working in Jordan that have sharia boards or sharia consultant and analyzing such reality in the governorship instructions issued from the Central Bank of Jordan at the institutional and individual level.

This study addresses the multiplicity of Sharia supervisory body members by indicating its disadvantages and the methods of addressing them, along with the institutional governorship for the work of sharia supervisory boards.

The study presents the general analysis of sharia supervisory boards in the Islamic financial intuitions working in Jordan.

The study concludes that banking and financial institutions achieved the requirements of the institutional governorship for Central Bank of Jordan at the institutional level.

Furthermore, the multiple membership for individuals do not exceed more than four institutions that do not accept deposits.

The study recommends preparing new specialized teams either by increasing the number of qualified scholars in sharia supervisory boards or training them by specialists to furnish them with the experience and skill in fatwa and sharia supervisory due to the lack of qualified staff in such fields.

It, moreover, recommends controlling the spread of sharia supervisory boards in the supervisory expansion that does not allow a thorough commitment of the central governing instructions.
