The importance of the study stems from the fact that the electronic sales contract raises a lot of concern with regard to some contractual aspects with regard to verifying the identity of the contractor, the lack of studies that show the controls of the electronic sale contract, and the adequacy and effectiveness of the controls set by the legislator in order to protect the contractor electronically.

And electronic transactions are constantly increasing among people, and electronic selling is characterized by characteristics that are not available in the sale contract concluded by traditional means.

The study also aims to know what is related to the electronic sales contract and what distinguishes it from traditional sales, to know the nature of the electronic sales contract, to know the controls of the electronic sales contract correctly, and the need for that method to reveal its legality.

The problem of the study lies in the increasing development in electronic commerce, including the conclusion of the sale contract via the Internet, and the lack of clarity of the general rules that control the electronic sales contract in particular, and the laws of electronic transactions in various countries did not address these controls directly, but rather it is necessary to refer to the controls of the contract.

Traditional selling, and also problematic is how to conclude a contract of sale by mutual consent in a virtual council and how to verify the identity of the contractors and their full eligibility through the Internet.

The study used the inductive analytical approach, by presenting the issues and developments related to the electronic sale contract from its sources and then analyzing them in order to reach results, and the documentary approach by documenting the information and issues that were studied by the research, and the comparative approach by comparing issues and developments and their approval of those electronic transactions and their compatibility With traditional methods.
