Abstract EN

It is obvious that the sperm banking issue makes thoughtful of religious men and law enforcement in order to know the provision of Islamic and legal laws for these sperm banking, the researcher conducted this paper in three dimension for sperm banking.

The study based on the analytical inductive approach as main data analysis,The study aims to get the benefits from cryopreservation of those DNA in experts and research, regardless its strictly forbiddances, and also aims to know the conditions which it could be allowed to cry preserve those sperms.

The researcher takes the fact of sperm banking, it is inception and the reasons of emergence the sperm banking and the laws which resulting on it is inception from its destruction, the cryopreservation and the law of getting advantages from these sperm backing.

The researcher found out that bank is a laboratory with physical and chemical characteristics to keep the sperm for specific period, the jurists have agreed that the bank which mixing up without knowing the identity is forbidden and it is now allowed to deal with it.

The reason of establishing these banks either for having the innate desire or gaining the material desire, and it is very important when zygote taking only the act amount is needed so as to avoid the additional excess, if there is an excess it must be put out without any medical attention until it pass away naturally.

It is possible to use the excess zygotes test from tube babies if their parents donated, and it can’t be used in illegal pregnant.
