Abstract EN

This article aims to highlight one of the general syntactic evidence, which is the evidence of (Istishab alhal), according to Tajuddin Al-Isfarayini (D.

684ah), in his book “Almiftah fi Sharh Almisbah”.

It also aims to investigate and trace the grammatical origins that Tajuddin Al-Isfarayini had established, clarifying its branches, and highlighting the manifestations of his inference and analysis in his abovementioned book.

The study employs the descriptive approach that describes the manifestations through the texts of Tajuddin Al-Isfarayini.

It is proven in settling the origin of the syntactic evidence.

It also employs the analytical approach by classifying the origins according to the type of the origin between rules and position, and then clarifying the inference in it.

The study concludes with a number of findings, the most important of which are: The term “Istishab” according to Tajuddin Al-Isfarayini is reliable evidence of the general syntactic evidence.

He relied on the origin in explaining the syntactic rules and their explanation and responding to the opponents of his approach without diminishing its importance or detracting benefit from other evidence even if he did not declare the agreed upon term, taking a considerable care of the theory of origin and branch.

Among the manifestations of this is that he settled the origin of the rule with an explanation of its branches.

As for the origin and position of the word, he sets three types, as well as that of the sentence.

His use of these rules may be taken as evidence to assert a syntactic rule, or to justify previous rules in the context while mentioning the different views on the issue, or perhaps to explain its first origin.
