Abstract EN
Abstract Good faith is one of the basic principles particularly in civil law.
After agreeing on the contract between the parties, and if the contract is valid and binding on both parties, it is not sufficient to implement the contract according to what it contains.
The contract must be executed in good faith and with all what it implies including trust, honesty and integrity to achieve the intended benefit of the contract.
The consequence is the penalty resulting from the extent to which a person has good faith or bad faith (i.e.
the penalty for committing or breaching good faith).
In addition, it means that the legislator considers breaching the good faith as a breach of public order, because the society rejects any aggression or harm to others and any breach of legitimate trust.
This breach requires the enforcement of severe legal penalties that amount to penalties on the person who breaches his obligation.
As a result of the tremendous development in the World Wide Web, the Internet has emerged, replacing traditional tools with electronic means, including contracting via the internet, in addition to using electronic means to disseminate news at a high speed, which often reflects the bad faith of the publisher or the journalist.
Consequently, it results in the news’s loss of credibility.
This study shows the concept of good faith and the consequences that it has in case it is violated.
Violation of this obligation may lead to harm to others, and consequently the journalist is held responsible, and then the consequence is due, which is compensation for the news that the journalist has published.
The journalist's commitment to the credibility of the message entrusted to him indicates his good intention to publish it, and it is a principle that expresses the preservation of honesty and trust in dealing, which requires sincerity, honesty and integrity in the implementation of all obligations arising from both parties.
