Abstract EN

This study is concerned with designating the provisions that regulates the criminal responsibility of both the prime minister and the ministers according to the Jordanian constitutional legislative provisions, the interpretation of those provisions, and the elaboration of the shortcomings of those provisions.

the study adopted the descriptive approach, using its analytical and critic tools.

this study deals with identifying the current legal framework concerning the criminal responsibility of both the prime minister and ministers.

moreover, this study suggests that the ministers criminal responsibility could be tackled through a joint session convened by the senate and the house of representatives (the national assembly), with an indication of the preference of this proposal.

this study concluded several findings; perhaps the most important of them is that the parliament’s exercise of the authority to initiate the criminal responsibility of the prime minister and the ministers should not prevent the public prosecution from being able to initiate their responsibility, as it has the general mandate to initiate the penal responsibility and prosecute the perpetrators of crimes.

the study recommended the involvement of the senate in initiating the criminal responsibility of the ministers through a joint session to be held between the senate and the house of representatives.
