The maritime carrier undertakes to perform the operation of maritime transport by following the agreed route or, failing that, the usual route.

the carrier is liable for damage to the cargo in the event of deviation unless it appears that the carrier's failure to follow the maritime route is due to a reasonable deviation of the ship.

this is a case of legal exoneration from liability according to the second paragraph of article 775 of the Algerian maritime code in its French wording ; as derived from article 4 (4) of the Brussels convention for the unification of certain rules relating to bills of lading concluded on 25 august 1924.
