Islam has ensured that they have their right, and their first needs, to preserve them from what harms them, and to carry out their interests, once the family is stable and separated.

Jurists have worked hard to establish standards and conditions for the guardian, which, ensures the care of the children and provides him with the right environment.

Because of the critical importance of the nursery issue, I saw that I should collect the criteria and conditions that must be met in the custody.

In order to complete the interest, the personal status system of the Saudi Ministry of Justice has been completed.

The research problem is focused on knowing what criteria to provide in the guardian, which we explain in the following questions: 1- Who's more entitled to custody? 2- What are the criteria for custody, are they private or common to men and women? 3- What does it entail when one of its conditions is left behind? The most important results: 1- Custody is obligatory in kind, if only him, and with others, it is sufficient.

2- The jurists agree that the mother is the right to be the most deserving of thetruth, unless she marries.

3- Custody criteria are divided into three sections: common between men and women, especially women, especially men.

It followed the approach of extrapolating and tracking the words of jurists on what they considered conditions of custody.
