This study deals with the issue of virtual currency, as technological development and the spread of the Internet in all fields, including the economic and commercial sphere, led to the emergence of a virtual currency (Bitcoin), the latter is only dealt with at the level of open markets on the Internet, and it is noticeable that people and economic entities rush to adopt it, in light of the attraction The legal position of the virtual currency between the law and the economic reality imposed by sweeping globalization at the level of trade and the economy in general, and accordingly a problem arises on this topic related to what is the virtual currency (Bitcoin) and the ability of the law to confront the problems created in light of the inevitability of the practical reality of this virtual currency.

Algeria is considered a country that hastened to prevent dealing in the virtual currency (Bitcoin) due to the necessities of the stage and the lack of clarity of the idea and its crystallization at the legal level, where the virtual currency (Bitcoin) puts an end to the well-known traditional commercial and economic rules and puts the traditional economic entities outside the economic game by changing the concepts of control, monopoly and traditional economic influence.
