The subject of legal protection of public sector employees and workers is one of the issues that concern jurisprudence and the judiciary as well as the legislator in various contemporary legal systems, and given the transformation as a political event in Libya after the Arab spring, it has become urgent to review the system of legal protection in this area.

the country is in the light of developments in case law and the judiciary which France has recently witnessed at this level, so we felt that we should devote this study to one of these important legal guarantees and reveal the shortcomings of Libyan legislation by relation to French legislation.
