Abstract EN

The research aims to identify the executive competencies of the head of state in Iraq by studying the study of the Iraqi constitution.

The research followed the analytical and inductive approach in order to reach results, including: that the task of the head of state - with regard to the implementation of laws – is limited to instructing the ministry to implement laws, through the issuance process, so the president does not play an essential role in this task except when there is no the position and solutions of the President of the Republic replace the Prime Minister.

The Iraqi constitutional legislator has gone along with the foundations of the parliamentary system, which entrusted the law enforcement process to the ministry, but it violated them in the process of replacing the prime minister when the position becomes vacant.

The freedom of the head of state to appoint the prime minister is limited to choosing the candidate of the largest parliamentary bloc, if the latter chooses its candidate.

The head of state has nothing but approval.

As for the dismissal of ministers or the prime minister, the head of state does not have the power to dismiss any of them.

All he can do is submit a request for dismissal to Parliament.

The latter decides on the president’s request, by accepting or rejecting, and this is contrary to what is the case in Britain in which he owns The head of state has the right to appoint and dismiss the prime minister.
