The right to litigation is one of the most important rights guaranteed by the constitution and regulated by law.

In fact, it is not just a right related to resorting to the judiciary; Rather, it is an important peaceful means for protection, social and human peace, and to maintain security and public order.

In order to achieve peaceful coexistence among members of the same society without discrimination or discrimination between them for any reason whatsoever, as it prevents the use of force and the enforcement of the right against its will and aggression against citizens, as it was in ancient times.

This brief study deals with the right to litigation from several aspects, related to the statement of its nature and its role in achieving social peace, and the legislator's philosophy in ensuring it in a way that achieves a balance between the conflicting interests of the opponents, and regulates the means and procedures for directing this right, and what is decided to use it from guarantees, then how Facilitating its use by developing litigation mechanisms and procedures.
