Abstract EN

This article aims to highlight the Algerian legal system of the tourism sector by granting the privilege of using and exploiting thermal waters, through describing and analyzing the legal texts and executive decrees governing them.

The article also seeks to show the effectiveness of strengthening the authority of the governor to grant the privilege of using and exploiting thermal waters as a mechanism for promoting tourism investment.

The reality imposed by the tourism sector of promoting tourism investment in general and investment in thermal waters in particular, as well as the new legislative policy to expand the powers of governors to conduct local affairs, overcoming investment procedures and reducing centralization of decisions on tourism investment, this has made it imperative for the Algerian legislator to move from centralization towards decentralization concerning the use of thermal waters.

The aim is to promote tourism investment by adopting preventive and administrative measures aimed at reducing and addressing the illegal use and exploitation of thermal waters.
