The issue of public procurement corruption has received much attention from statesmen and researchers in recent times, after the unprecedented rise in corruption rates in this field, so that anti-corruption mechanisms did not record the desired ambition of the government, and evidence of this is the slight decline recorded by Algeria in the global Corruption Perception Index.

From the 106th place in the world in 2019, To the 104th place globally in 2021, according to what was issued by Transparency International for the years§2019 and 2021, and with the increase in moral scandals and irresponsibility in terms of managing the expenses of public deals and violating the law, voices calling for the need to combat corruption in public deals rose by promising to establish a code of its own, which has not been implemented for years since the launch of the project to prepare it, This article came to study the reasons and reasons for codifying the rules governing administrative behavior in the field of public deals and the backgrounds of the failure to issue a code of its own, as well as the obligations that can be added in the code to be approved as rules to be used as a control measure to study the feasibility of completing the deal and the rights and duties of its parties, and we concluded that it must be emphasized To add a deterrent formula in the adopted rules, if they are issued, in order to reduce fraud and create a new aspect of anti-corruption mechanisms, especially since the matter is related to public money, the public interest, and serving the country and the citizen.
