Abstract EN

This study aims at addressing the principle of “freedom of investment, trade and enterprise”, which came in the text of article 61 of the recent 2020 constitutional revision, which made many promises, especially at the economic level, in order to reach a productive economy far from the reinter economy that is based on hydrocarbon revenues only; and without prejudice to the social character of both the Algerian economy and the privacy of the Algerian society.

In light of a legal issue that is related to what extent does the new constitutional principle impact Algeria's legislative policy in the economic field, the new constitutional amendment addressed a review of investment based mainly on providing several incentives and guarantees to the investor, including the right to establish small and medium enterprises and obtain subsidies from the state to create several economic projects.

and also – for the first time in Algeria- for the right to contact, this latter will be devoted to a stage based on the anticipation of contracting activity, which is of a great importance in providing jobs, eliminating the problem of unemployment and providing income to the public treasury through the promotion of treasury revenues from taxes.
