The justice is the competent part in protecting the rights provided by the Legislator such as the right for the estate.

Thus, this paper aims at shedding light on one of the most important frames and legal mechanisms provided by the law in the field of the legal intervention to protect the property which is the mechanism of the civil and penal justice.

Findings show that the intervention of the justice for the protection of the particular property with is different qualitative specialties is a real guarantee in facing the various violations regardless their nature and source.

However, this protection is lacking as long as the content of the texts that punish the violators is not activated.
