Medical work is considered to be humanitarian work before it is professional, it falls on the human body and any fault thereof may cause harm to the patient seeking treatment, resulting in the responsibility of the therapist.

since most medical work, especially surgical work, is done through the joint work of several doctors and assistant health practitioners, the problem of liability within the medical team has been raised in the event of a fatal error in the patient.

through this study, we deal with various jurisprudence, certain jurisprudence and legal texts and analyse them in order to determine civil liability in the case of the work of the surgical medical team.
