The element of damage is considered one of the main pillars on which liability is based in general and administrative responsibility in particular, as there is no liability without harm, and the damage is of two types: material and moral, and both require compensation, but although it is easy to estimate the material damage, the matter is surrounded by some the difficulties with regard to moral damage, since the process of assessing it is somewhat complicated, and this will be discussed in some detail in our study, through researching the concept of moral damage, by giving a definition of it, and clarifying its most important forms, as well as addressing the position of the administrative judiciary in each of France and Algeria towards the issue of compensation.
