This article examines the scope of the judge's intervention in the Exception of unconstitutionality in the Algerian, Moroccan and Egyptian legislation, as a method for judicial control of the constitutionality of laws And a mechanism for protecting the rights and freedoms guaranteed by the constitution, In Egyptian legislation, the judge can automatically file the exception of unconstitutionality laws or regulations and direct referral to the Supreme Constitutional Court, While the Algerian and Moroccan legislators have adopted a dual system of Filtering and referral, And the judge excluded the possibility of automatic Exception And limiting its subject matter to laws without regulations.
