Arbitration is a judicial act of a special nature based on the principle of the freedom of the parties to the legal relationship to choose the means of settling their disputes, whose jurisdiction derives from the agreement of the parties rather than the law, and the arbitral dispute begins once the parties to the contract have declared their wish to initiate arbitration proceedings against the party to the contractual association.

The task assigned to the arbitral tribunal by considering the dispute begins with the search for the applicable law, and through the action of invalidity the judgement can be set aside if there is a defect to invalidity.
