The control of the constitutionality of laws us a necesary guarantee for the rule of law which guarantees the supremacy of the constitution and the need to observe its rules by the public authorities and especially by legislator with regard to its laws.

This control involves the establishment of the Algerian constitutions council whose misson differed according to the succession of Algerian constitutions until the object of the 2016 constitution which was entrusted with the mission of controlling the constitutionality of the laws under two mechanisms of prior control and subsequent control which raises a dispute over the legal nature of the constitutional council by considering it as a political or judicial body.
