Private security companies are private commercial entities that provide security and/or military services.

The presence of these companies has become common in various parts of the world.

It has even become a growing phenomenon on the international scene, where many countries have resorted to use the services of these companies to perform many of the tasks that were performing.

Moreover, the humanitarian and private institutions rely on the services of the security companies in order to secure their operations.

However, the increase in the external delegation of military and security tasks has put the employees of private security companies into direct contact with people protected by international humanitarian law, such as civilians.

This is what raise the issue of determining the legal status of the employees of these companies and to what extent the description of mercenaries applies to them, especially in the case of the practice of those employees prove that they have committed grave violations to the rules of international humanitarian law.
