Abstract EN

The theme of the research is the rule of (bringing benefits and eliminating vices) and building the legitimate provisions thereon.

It indicates that the study of such subjects demonstrates the strong relationship between sharia and human life and that linking the rules of Jurisprudence (Fiqh) to contemporary regimes proves the universality of Sharia.

Furthermore, this research shows how great this rule in sharia is as it's considered one of the ways that prove the provisions, it is also a statement of purpose of this rule by its individual and overall meaning.

This research also assures the guide to its legitimacy and the importance of inferring them, The rule of Bringing Benefits and Eliminating Vices is a vivid statement among scholars.

To bring all benefits and eliminate all vices is a must, this is accompanied with the stating the controller of the required interests to be achieved, the vices to be eliminated, and the the departments of interest that are out and in the consideration of Alsharia and judging conflicts in case of having opposition in benefits and vices.

Besides, Islam's concern with the elderly, its more developed civilization, assurance of its systemic and legal rights, statement of the characteristics of the elderly that is worthful of these rights that are guaranteed by sharia and legal system, all of that are discussed in the research.

In addition, the research indicates what is meant by the elderly's rights and caring of them, clarifies the relationship of the elderly's rights system to the rule, and the applications of the system that highlights their relationship.
