Abstract EN

This research deals with an important topic in the origins of jurisprudence, namely, the rule, (blocking the pretexts according to Al Hanafia, an applied fundamentalist study, which is a mean of preserving the purposes of the Islamic provisions, and a manifestation of the flexibility of Islamic law, through the rooting of this rule according to Hanafi scholars, and mentioned some of the branches in which A Hanafia applied to block the pretexts.

I have made the research in an introduction, a preface, three chapters, and a conclusion, the preface includes: the definition of blocking pretexts, the pillars of the pretext, and the sections of pretexts, and the first research in: the relationship between blocking pretexts and some fundamentalist and doctrinal concepts, including The relationship between blocking pretexts and interests, the relationship between blocking pretexts and approval, and the relationship between blocking pretexts and tricks, and the second topic is: the legitimacy of blocking pretexts, the argument of blocking pretexts at tap, and the controls of working to block pretexts.

The third is: applied models to block the pretexts according to Al Hanafia.

The research has included: models of work to block pretexts in worship, models of work to block pretexts in transactions, models of work to block pretexts in family provisions, models of work to block pretexts in penalties and crimes, and models of work to block pretexts in the judiciary.
