إن الطبيعة الخاصة التي تتميز بها عقود الدولة، كون أن أحد طرفيها دولة ذات سيادة، جعلت من قانونها هو الذي ينبغي إعماله من قبل المحكم إذا ما تم نشوء منازعات عن العقد.
إلا أن هذه الفكرة تعتبر نسبية، إذ أنه بالرغم من تأكيد عديد من الفقهاء و التشريعات القانونية و القضائية على توطين هذه المنازعات، فإن الواقع العملي لقضاء التحكيم يبين تدويل عقود الدولة لاعتبارات متعددة
Abstract EN
The special nature of state contracts, as one of its parties is a sovereign state, has made it their law that should be applied by the arbitrator if disputes arise over the contract.
However, this idea is not absolute, dispite the fact that many jurists and legal and judicial legislations have emphasized the localization of this disputes, but the practicality of arbitration shows the internationalization of stat contracts due many considerations.

La nature spéciale qui caractérise les contrats d’État, parce qu’un de ses parties est un état souverain, elle a défini que leur droit ce qui devrait être applique par l’arbitre s’il y a des différends contractuelles.
Mais cette idée n’est pas absolue, où malgré que les affirmations de nombreux juristes et législations juridiques et judiciaires sur la localisation de ces litiges, cependant la réalité pratique du l’arbitrage montre l’internationalisation des contrats d’État, en raison de plusieurs considérations.
