يشكل القضاء الدستوري آلية لحماية الحقوق و الحريات المنصوص عليها دستوريا من تعسف المشرع اثناء تنظيمها، و يظهر ذلك جليا في قضاء المجلس الدستوري الفرنسي الذي كان له دور إنشائي في هذا المجال، و هو ما تبينه قراراته في مجال المحاكمة المرئية ما يبين فلسفته في الموازنة بين الحقوق و الحريات و حفظ النظام العام و المال العام.

English Abstract

The constitutional judiciary constitutes a mechanism to protect the rights and freedoms stipulated in the constitution from the arbitrariness of the legislator during their organization, and this is evident in the judiciary of the French Constitutional Council, which had a constructive role in this field Public order and public money.
