Arabic Abstract

كان للتطور التكنولوجي و الثورة الرقمية الأثر المباشر على المجال القضائي الذي واكب هذه العصرنة و تبناها بدخوله عالم الرقمنة، فتم تطبيقا لتقاضي الالكتروني، باعتباره أحد آليات الرقمنة، يفترض فيه أن يكون تكريسا لمزيد من الضمانات التي تتجسد أساسا في سرعة معالجة الملفات و الفصل فيها، و تسهيلا للجوء للقضاء، و تبسيطا لإجراءات، فأقر المشرع الجزائري ما يسمى برقمنة قطاع العدالة.

لكن في الممارسة العملية تواجه رقمنة هذا القطاع سلسلة من العقبات، على أساس أن التحول الإلكتروني للإدارة عموما لا يعني أن الطريق ممهد لتطبيقها و تنفيذها بكل سهولة، بل هناك العديد من العراقيل التي يمكن تقسيمها إلى: معوقات قانونية، و معوقات مرتبطة بالمورد البشري، و معوقات مادية.

English Abstract

Technological development and the digital revolution have had a direct impact on the judicial sphere, which has kept pace with this process and adopted it by entering the world of digitization.

Thus, the application of what is known as electronic litigation as one of the mechanisms of digitization, which is supposed to be the consecration of more guarantees, mainly in the speed of processing and processing of files, in order to facilitate access to justice and to simplify procedures.

In practice, however, the digitization of this sector runs into a series of obstacles, on the grounds that e-governance in general does not mean that the way is paved for its easy application and implementation, Legal, human resource and material constraints, with various possible solutions to overcome them.
