Arabic Abstract

تناولت في هذا البحث إحدى القضايا الفقهية الطبية المستجدة في هذا العصر، والتي يحتاج الناس إلى معرفة الحكم الشرعي فيها، وذلك لأهميتها وحاجة الناس إليها في حياتهم الاجتماعية وهي قضايا الإخصاب المساعد بما يشمله من تلقيح صناعي، وتحديد جنس الجنين، والبنوك المنوية.

وقد قسمت البحث إلى مقدمة، وتمهيد، ومبحثين، وخاتمة، أما المقدمة فتضمنت أهمية البحث، ومشكلته، وخطته، والمنهج الذي اتبعته في البحث، وأما التمهيد فتضمن معنى التجديد، وهل قضايا الإخصاب المساعد مستحدثة لم تكن موجودة في العصر الماضي؟، وأما المبحث الأول وهو بنوك النطف والأجنة، فقد اشتمل على ثلاثة مطالب: أولهما: المقصود ببنوك النطف والأجنة، وثانيهما: حكم إنشاء بنوك النطف والأجنة، وثالثهما: المشاكل التي تثيرها بنوك النطف والأجنة، وأما المبحث الثاني وهو التلقيح الصناعي وتحديد جنس الجنين، فقد اشتمل على أربعة مطالب: الأول: مفهوم التلقيح الصناعي لغة واصطلاحا، والثاني: أنواع التلقيح الصناعي والحكم الشرعي لهما، والثالث: أسباب اللجوء للتلقيح الصناعي، والرابع: حكم تحديد جنس الجنين، وأما الخاتمة فتضمنت أهم نتائج وتوصيات البحث.

English Abstract

In this research I deal with issues of medical issues emerging in this era, in which people need to know the legal ruling on them, due to their importance and people's need for them in social terms, which are fertilization issues, including artificial insemination, fetal sex, and sperm banks.

the research was divided into an introduction, an introduction, two papers, and a conclusion.

as for the introduction, it included the importance of the research, its problem, its plan, and the methodology that it followed in the research.

as for the introduction, it included the meaning of renewal, and are the issues of assisted fertilization new and not present in the past era? as for the first research, which is banks of sperm, it includes three requirements: the first of them is: what is meant by banks the ruling on establishing sperm banks, and the third is the problems raised by the sperm banks.

as for the second topic, which is artificial insemination and determining the sex of the fetus, it includes four demands: the first: the concept of artificial insemination in language and convention, and the second: the types of artificial insemination and the legal ruling for them, and the third: the reasons for resorting to artificial insemination, and the fourth: the ruling on determining the sex of the fetus.

as for the conclusion, it included the most important results and recommendations of the research.
